1. Acceptance of terms
By accessing FokOffMense on the web (https://fokoffmense.co.za) or through our Android mobile app, you agree to these Terms of Service and our Privacy Policy. One account works across website and app.
2. Service description
FokOffMense provides privacy and anti-spam tools for users in South Africa, including:
- Spam reporting and community intelligence (calls, SMS, email, and related channels)
- POPIA request generation and sending (on eligible plans)
- Upload of your own Google Takeout spam/promotions export to identify senders (website)
- Optional breach monitoring via Have I Been Pwned (multiple email addresses on Premium/Family)
- Optional Gmail filter setup to label and trash senders you choose (website — see section 8)
- Exposure score and dashboard insights based on breaches and your own reports/uploads
- Android app: report spam from your phone, view recent calls/SMS you allow the app to read locally, optional call screening for blocked numbers, push notifications for POPIA and breach updates, and in-app support
We do not access illegal databases or government systems without authorization. Sign-in with Google is separate from optional Gmail filter connection — connecting Gmail is always your explicit choice.
3. User responsibilities
You must provide accurate information, not abuse reporting or upload features, and comply with POPIA when processing others' data. You are responsible for ensuring you have the right to upload any export or file you submit (i.e. it is your own mail data).
4. Subscription and billing
Paid plans are billed through Paystack (South African Rand). You may cancel at any time from Settings; access continues until the end of the billing period.
Refunds: contact support@fokoffmense.co.za within 7 days of a charge if the service did not work as described. Cancellations stop future charges; we do not guarantee refunds for partial months after use.
Family plans cover one account holder plus household members they invite. Each invited member signs in with their own email; only the account holder manages billing.
5. Dashboard, exposure score, and scans
Your exposure score is based on known data breaches (when you enable monitoring) and your own spam reports and Takeout uploads — not probabilistic guesses from a marketing directory alone.
Optional community privacy scans show companies reported by other users. These are indicators, not proof that a company holds your data or has contacted you. POPIA emails are sent to contacts we discover; we do not guarantee company response or compliance.
Community Shield (the shared block list on web and Android) only shows companies after at least ten (10) approved community reports from at least three (3) different users. Blocking a number from your own call or SMS history is separate and immediate on your device — you always choose what to block. One user cannot add a personal contact to the shared list for everyone else.
6. Android mobile app
The Android app is optional. If you grant call log or SMS permission, the app reads recent entries on your device only to display a list you can tap to report — we do not upload, archive, or store your call log or SMS history on our servers. Only reports you submit (for example sender number and details you add) are sent to us.
Optional call screening may reject incoming calls from numbers you block. You are responsible for numbers you block and for ensuring you do not screen calls you still need (for example from banks, courts, or employers). FokOffMense is not liable for missed calls or messages when screening or blocking is enabled.
Push notifications are optional. You can disable them in Android settings without closing your account.
7. Spam export (Google Takeout) uploads
You upload your own Takeout file. We parse sender information, update your dashboard, and delete the file from our servers after processing. Re-uploading refreshes your sender lists. Upload limits apply as shown in the product.
8. Gmail blocking (optional)
If you opt in, FokOffMense creates Gmail filters and a label named FokOffMense on your Google account to skip inbox and trash mail from sender addresses you selected from your upload (where we cannot send POPIA). You can view, edit, or delete these filters in Gmail at any time.
Important: Trashing mail is your choice. Mail matching these filters may be deleted or moved to Trash automatically. You are responsible for ensuring you do not block senders whose mail you still need (for example legal, financial, or account notices). We do not monitor your inbox for missed messages. See also section 9.
Disconnecting in FokOffMense removes our filters and stored tokens; you may remove the label separately in Gmail.
9. Opt-outs and your legal obligations
When you use FokOffMense to opt out, object to marketing, request deletion, or otherwise ask a company to stop processing or contacting you — or when Gmail filters stop mail from arriving — that company or sender may honour your request by reducing or stopping communications, including emails, SMS, calls, and postal mail.
You are solely responsible for your own legal, financial, and contractual obligations. Opting out or blocking mail does not suspend debts, court orders, statutory notices, insurance claims, employment requirements, or other matters where you may still be required to receive or respond to communication.
If you opt out, block senders, or trash filtered mail and later miss important notices — for example legal letters, summons, payment demands, or account warnings — that is your risk. You should keep your own records, monitor accounts you care about, and seek independent legal advice where needed.
To the fullest extent permitted by South African law, FokOffMense, its operators, and affiliates will not be liable for any loss, damage, penalty, legal cost, or other consequence arising from your decision to opt out, block mail, or not receive communications you might otherwise have received.
10. Limitation of liability
FokOffMense provides tools to assist with privacy rights. We do not guarantee company compliance with POPIA requests, successful opt-outs, correct Gmail filter behaviour, call screening behaviour, or any particular outcome. Except where liability cannot be excluded by law, our total liability to you for any claim relating to the service is limited to the amount you paid us in the twelve (12) months before the claim (or R0 if you use a free plan).
11. Governing law
These terms are governed by the laws of the Republic of South Africa.
