1. Acceptance of Terms

By accessing FokOffMense, you agree to these Terms of Service and our Privacy Policy.

2. Service Description

FokOffMense provides privacy protection tools including spam reporting, POPIA request generation, company directory search, and privacy monitoring. We do not access illegal databases or government systems without authorization.

3. User Responsibilities

Users must submit accurate information, not abuse the reporting system, and comply with POPIA when processing others' data.

4. Subscription & Billing

Paid plans are billed through Paystack (South African Rand). You may cancel at any time from Settings; access continues until the end of the billing period.

Refunds: contact support@fokoffmense.co.za within 7 days of a charge if the service did not work as described. Cancellations stop future charges; we do not guarantee refunds for partial months after use.

Family plans cover one account holder plus household members they invite. Each invited member signs in with their own email; only the account holder manages billing.

5. Privacy scans & POPIA requests

Exposure scans show possible matches from our directory, community reports, and breach APIs — not confirmed proof that a company holds your data. POPIA emails are sent to contacts we discover automatically; we do not guarantee company response or compliance.

6. Opt-outs and your legal obligations

When you use FokOffMense to opt out, object to marketing, request deletion, or otherwise ask a company to stop processing or contacting you, that company may honour your request by reducing or stopping communications — including emails, SMS, calls, and postal mail.

You are solely responsible for your own legal, financial, and contractual obligations. Opting out through our service does not suspend debts, court orders, statutory notices, insurance claims, employment requirements, or other matters where you may still be required to receive or respond to communication from a company, creditor, lawyer, or regulator.

If you opt out (or a company stops contacting you after a request we send on your behalf) and you later miss important notices — for example legal letters, summons, payment demands, or account warnings — that is your risk. You should keep your own records, monitor accounts you care about, and seek independent legal advice where needed. We do not monitor your post, inbox, or legal mail on your behalf.

To the fullest extent permitted by South African law, FokOffMense, its operators, and affiliates will not be liable for any loss, damage, penalty, legal cost, or other consequence (including trouble with lawyers, courts, creditors, or regulators) arising from your decision to opt out, from companies honouring an opt-out, or from you not receiving communications you might otherwise have received.

7. Limitation of Liability

FokOffMense provides tools to assist with privacy rights. We do not guarantee company compliance with POPIA requests, successful opt-outs, or any particular outcome. Except where liability cannot be excluded by law, our total liability to you for any claim relating to the service is limited to the amount you paid us in the twelve (12) months before the claim (or R0 if you use a free plan).

8. Governing Law

These terms are governed by the laws of the Republic of South Africa.
